Terms, Conditions of Use, and Privacy Policy for the hkoffee SAT Mobile App

These Terms and Conditions govern the download, access, and use of the hkoffee SAT mobile app (hereinafter referred to as the "APP"), which Himikode Tech SL makes available to users. The user acquires this status upon downloading and using the app.

This version of the APP is available for free on Google Play and the Apple App Store. The user acknowledges and agrees to comply with all applicable terms and conditions regarding the acquisition, download, and update of the APP as determined by these stores respectively.

Accessing the APP implies that the user acknowledges having accepted and consented to these terms of use without reservation.

Purpose

The APP aims to register and manage SAT interventions on your espresso machines and coffee grinders. Some of the groups that can benefit from this project include the clients/collaborators of Himikode Tech SL, who are provided with access credentials and a password derived from a prior contractual agreement. Professionals with specialized expertise were involved in the design and development of this APP, which operates on mobile phones with Android or iOS operating systems.

Clients and SAT technicians have instant access to all the information necessary to make quick and efficient decisions, maximizing the lifespan of the machines and improving the quality of technical service. The hkoffee APP offers:

• Monitor real-time consumption: Increase the profitability of your machine fleet by controlling their consumption and status in real time.
• Check remaining lifespan: Know the real-time status of your machine fleet and spare parts, and anticipate issues before they occur.
• Access intervention history: Improve the planning of your SAT operations with a centralized record.

Intellectual and Industrial Property Rights

The intellectual and industrial property rights to the APP are owned by Himikode Tech SL, which holds the exclusive rights to exploit them in any form, particularly the rights of reproduction, distribution, public communication, and transformation.

Third parties holding intellectual and industrial property rights over photographs, logos, and any other symbols or content included in the APP have granted the necessary authorizations for their reproduction, distribution, and public availability.

The user acknowledges that the reproduction, modification, distribution, commercialization, decompilation, disassembly, use of reverse engineering techniques, or any other means to obtain the source code, transformation, or publication of any test results or unauthorized references of any of the elements and utilities integrated into the development constitutes an infringement of Himikode Tech SL's intellectual property rights. Consequently, the user agrees not to perform any of the aforementioned actions.

Privacy Policy

Who is responsible for processing your personal data?

Himikode Tech SL is responsible for the processing of the user's personal data and informs them that this data will be handled in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD). What is the purpose of processing your personal data?

We process your personal data for the purposes described in section "1. PURPOSE" of these terms and conditions, namely, to manage user access to the app's database and to record SAT service interventions on coffee machines/grinders. This includes, but is not limited to, information on: identification, username, and password.

What is the legal basis for processing your personal data?

The processing of your data is legitimized as it is necessary for the contractual relationship, of which you are a part, established by accepting these terms and conditions of use (Article 6.1.b GDPR).

How long will we retain your personal data?

We will retain your personal data for no longer than is necessary to fulfill the purpose of processing, that is, for the duration of the contractual relationship related to the use of the APP (including the obligation to retain it during applicable limitation periods). Once it is no longer needed for this purpose, it will be deleted using appropriate security measures to ensure its anonymization or complete destruction.

To whom do we disclose your personal data?

Your personal data will be disclosed to:

• Public administrations and other private entities to comply with the legal obligations to which Himikode Tech SL is subject due to its activities.
• Service providers who need access to user personal data to deliver the services contracted by Himikode Tech SL, or who may access certain personal data as part of the operation of electronic services (application, website, and emails). Himikode Tech SL has signed confidentiality agreements and data processing contracts with all such entities as required by law to protect your privacy (Article 28.3 GDPR).

What are your rights as a user?

Any individual has the right to obtain confirmation as to whether Himikode Tech SL is processing personal data concerning them or not. You have the right to request access to personal data related to you, its rectification or deletion, restriction of its processing, objection to processing, and data portability. We inform you that you also have the right to withdraw any consent you have provided for a specific purpose, as well as to file a complaint with any supervisory authority.

Mandatory or Optional Nature of Information Provided by the User

By ticking the appropriate boxes and entering data in the fields marked with an asterisk (*) in the app's forms, users explicitly, freely, and unequivocally agree that their personal data is necessary for the service provider to process their request. Including data in other fields is voluntary. The user guarantees that the personal data provided to Himikode Tech SL is truthful and is responsible for communicating any changes to them.

Himikode Tech SL informs that all data requested through the APP is mandatory, as it is necessary to provide an optimal service to the user. If all the required data is not provided, it cannot be guaranteed that the information and services provided will fully meet the user's needs.

Security Measures

In accordance with current regulations on personal data protection, the CONTROLLER complies with all provisions of the GDPR and LOPDGDD for the processing of personal data under its responsibility, particularly the principles outlined in Article 5 of the GDPR. These principles ensure that data is processed lawfully, fairly, and transparently in relation to the user and that it is adequate, relevant, and limited to what is necessary for the purposes for which it is processed.

Himikode Tech SL guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and LOPDGDD to protect the rights and freedoms of users and has provided them with adequate information to exercise these rights.

All information transfers performed by the APP with cloud servers, whether owned or third-party, are carried out securely and encrypted using a secure hypertext transfer protocol (HTTPS), ensuring that the information cannot be intercepted.

Disclaimer of Liability

Himikode Tech SL reserves the right to edit, update, modify, suspend, delete, or terminate the services offered by the APP, including all or part of its content, without prior notice, as well as to modify the form or type of access to it.

Reasons for modification may include adapting to new legislation, changes in the APP itself, updates stemming from applicable codes of conduct, or for strategic or corporate reasons.

Himikode Tech SL is not responsible for the use of the APP by minors. The download and use of the APP is the sole responsibility of the user.

The APP is provided "as is" without any type of guarantee. Himikode Tech SL does not guarantee the final quality of the APP or its suitability for all intended purposes. However, Himikode Tech SL commits to improving the quality of the APP to the best of its abilities but cannot guarantee the accuracy or timeliness of its content.

The responsibility for using the APP rests solely with the user. Except as provided in these Terms and Conditions, Himikode Tech SL is not liable for any loss or damage related to the download or use of the APP, such as those caused by malfunctions, crashes, or failures (e.g., communication line errors, hardware or software defects, or internet network failures). Similarly, Himikode Tech SL is not responsible for damages resulting from the improper or inappropriate use of the APP by users.

Governing Law and Jurisdiction

The user agrees that Spanish law applies and that the Courts and Tribunals closest to the city of LUGO will have jurisdiction over any disputes arising from the interpretation or application of these terms. The user expressly waives any other jurisdiction.
